The Social Security Disability claims process has five stages as follows:

  • Application: The initial phase requires you to submit personal, employment and medical information. The information is then passed on to Disability Determination Services where a determination is made on your claim. More than two-thirds of initial applications are denied.
  • Reconsideration: If your application is denied, you may apply for reconsideration within 60 days of receiving a notice of denial. The SSA approves only around 12 percent of reconsidered applications.
  • Hearing: Presided over by an administrative law judge (ALJ), a hearing is the third stage of the process. This is an opportunity for you to present evidence and interview witnesses at a hearing, meaning that having an attorney can give you an advantage.   • Appeals council: If your claim is denied by the ALJ, you can appeal to the Appeals Council, which is again composed of ALJs who will review your case. Very few applicants succeed in their appeals to this body.
